Background
1. “artcove.co.uk” (hereafter AC) is an online retailer and publisher of
blank art greeting cards with one off line outlet:- “Platform One” Palmers Green Station, Aldermans Hill, Palmers Green, London N13 4PN.
2. AC retails art greeting cards from other publishers, However, one of our aims is to provide an additional outlet for artists to
promote their work without constraint.
3. AC also aims to promote Artists though its Blog.
Copyright & Licence
1. Under this agreement, Artists grant AC a non-exclusive right to print and
distribute their image in the UK and Member States of the European Union
on greeting cards only.
2. Artists remain the sole and exclusive owner of all Images delivered to AC
and of all right, title and interest (including copyright) in them.
3. Images must be original creations by the Artist and do not infringe on the
copyright of any other person. Artist are responsible for delivering signed
model releases and/or property releases where relevant or required.
Sales Reporting
1. AC will send a quarterly record of sale by e-mail to the Artist.
2. AC’s Website system records card stock, however, for peace of mind, AC
invite Artists to “secret shop” and check their balance to confirm AC are
honouring this agreement.
Term of Artist Agreement
1. This Artist Agreement can be terminated by either Party at any time in writing, however AC reserves the right to sell existing stock of the Artist cards up to a maximum of 50 per image.
Definitions
“Image” means a picture or image created through drawing, painting,
photography, computer imaging or any other form of illustration or
depiction.
“Artist” means the copyright owner of an image created through drawing,
painting, photography, computer imaging or any other form of illustration or
depiction.
Royalty Payments
1. AC will pay the Artist Royalties at a fixed fee of £0.15p (GBP) on every
card sold featuring the Artists image.
2. Royalties are paid quarterly (End of March, June, September, December),
however amounts under £5 would be rolled over to the next quarter unless
requested otherwise.
3. AC Royalties are paid directly to the Artist’s bank account.
Editing of images and quality control
1. Artist and AC agree this before the Artist image is sold.
Promotion
1. Under this agreement Artist allow AC to reproduce Images in Promotional
Media without payment.
2. Images used for promotion will acknowledge the artist where practicable.
3. AC will not provide your Image to others without your priory written
consent.
4. AC is entitled to decline any Images.
5. It is the Artists responsibility to advise of any error in the information
displayed with respect to Images on the Website or cards.
